CONNECT25 Terms and Conditions
1. Purpose of Event
The CONNECT25 event is an exclusive professional gathering organised by Device Technologies Australia Pty Ltd, ABN 40 058 091 973; (“DTA”) for Healthcare Professionals. Connect25 aims to provide attendees with the latest insights, training, and networking opportunities within the healthcare industry. The event will feature presentations from industry experts, hands-on training sessions, and opportunities for professional development. CONNECT25 is designed to foster knowledge exchange, professional growth, and collaboration among healthcare professionals.
2. Interpretation
2.1. In these Terms:
2.1.1. “Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth);
2.1.2. “Attendees” means Healthcare Professionals registered to attend the Connect25 event;
2.1.3. “Business Day” means a day in which banks are open for business and specifically excludes Saturdays, Sundays and Public Holidays in Sydney, NSW;
2.1.4. “Event” means the Connect25 event which will take place on 31 May 2025, at the Venue ;
2.1.5. “Healthcare Professional” means the definition of Healthcare Professional in the Medical Technology Industry Code of Practice;
2.1.6. “Venue” means Doltone House at Jones Bay Wharf, Level 3, 26-32 Pirrama Road, Pyrmont NSW 2009
2.1.7. “Website” means the internet-based portals that Device Technologies uses to provide information about it as a company and to provide access to its digital services, including registering for the event .
2.2. All references herein to “T/the organiser” include the owners and managers/organisers of the event (being DTA), and the Venue, their tenants, holding and affiliated entities, licensors, related body corporates (if applicable), any third party operator/supplier of the event (where the operator is not the Venue) and all their directors, officers, employees, managers, agents, representatives and contractors or other authority which has jurisdiction or authority in respect of any area where the event takes place.
2.3. Nothing in these Terms will be read or applied so as to exclude, restrict or modify or have the effect of excluding or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Competition and Consumer Act 2010 (Cth)) and which by law cannot be excluded, restricted or modified.
3. Registration
3.1. Registration: Attendees must register for tickets through the designated platform.
3.2. Registration Confirmation: Your registration will only be confirmed upon receipt of a successfully completed registration form.
4. Cancellation Policy
4.1. Cancellation by the Organiser: The organiser reserves the right to cancel or reschedule the event.
4.1.1. If the event is cancelled by the organiser, no refunds will be provided to attendees who have booked flights or accommodation, which is at the attendees own expense.
4.1.2. If an event is rescheduled or significantly relocated by the organiser, attendees who cannot or do not wish to attend the rescheduled or relocated event may cancel their registration.
4.2. Cancellation by Attendees: Attendees may cancel their registration by providing written notice by emailing intuitive@device.com.au.
4.3. Registrations cannot be transferred to another person.
5. Inclusions:
5.1. Registration includes:
5.1.1. Access to all presentations and training sessions;
5.1.2. Catering (meals and beverages); and
5.1.3. Alcohol (if applicable).
5.2. Accommodation and travel are not included and must be arranged separately by the attendees.
6. Variations to speakers, presenters, suppliers or exhibitors
6.1.1. The organiser reserves the right to add, withdraw, reschedule or substitute speakers, presenters, suppliers or exhibitors and/or vary the advertised program, venue, and seating arrangements.
6.1.2. The organiser reserves the right to modify the program, speakers, without prior notice.
6.1.3. Subject to clause 19, the organiser reserves the right to change the venue or timing of the Event by providing reasonable notice whenever possible.
6.1.4. In the event of force majeure (e.g., natural disasters, government restrictions, circumstance beyond the organisers control), the organiser may reschedule or cancel the event without liability.
7. Marketing and Promotional Material
7.1. By registering for the event, attendees agree to receive promotional material related to the event.
7.2. In accordance with the Spam Act 2003 (Cth), attendees will have the option to opt-out of receiving ongoing promotional material by clicking the unsubscribe link in emails.
8. Privacy and Data Protection
8.1. Attendees’ personal data will be used in accordance with DTA’s privacy policy for registration, communication, and marketing purposes.
8.2. By registering, you consent to the collection and use of your information as outlined in our privacy policy.
8.3. DTA will handle all personal information in accordance with its privacy policy, which can be accessed at https://www.device.com.au/privacy-policy.
9. Conditions of Entry
9.1. Admission to the event is subject to the organiser’s terms and conditions. In particular, the following form part of the organiser’s terms unless otherwise specified:
9.1.1. Attendees are expected to behave in a professional and respectful manner.
9.1.2. Late arrivals may not be admitted until a suitable break in the event.
9.1.3. Cameras and recording equipment (including mobile phones) may be restricted.
9.1.4. Attendees may be subject to a search of their person and/or possessions before entering the event.
9.1.5. By attending the event, attendees agree to be filmed and/or recorded, and grant permission for their image, likeness, and voice to be used by the organiser for any purpose without compensation.
9.1.6. Attendees agree to comply with all Government directions, orders, and regulations relevant to attending live events, which may be in place at the time of the event.
9.1.7. Attendees assume all risks associated with COVID-19 or other communicable diseases.
9.2. Venue Rules and Restrictions
9.2.1. Attendees must comply with the Venue’s policies and regulations, including any health and safety measures in place.
9.2.2. Smoking, unauthorised recording, or any illegal activities are prohibited on the premises.
10. Restrictions
10.1. The event is open to Healthcare Professionals only unless otherwise specified.
11. Right of Admission Reserved
11.1. DTA and the organisers of the event reserve the right to refuse entry or remove any individual from the event premises at their discretion. This includes, but is not limited to, individuals who:
11.1.1. Do not possess a validly registered ticket or pass.
11.1.2. Are under the influence of alcohol or drugs.
11.1.3. Engage in disruptive, abusive, or inappropriate behaviour. Harassment of any kind will not be tolerated.
11.1.4. Violate any event policies or regulations.
11.1.5. Pose a safety or security risk to other attendees or staff.
11.2. In such an event of any of the above, the attendee shall not be entitled to claim any refund of any amount pre-paid or any damages or compensation of whatsoever nature.
11.3. By registering for a ticket or attending the event, you agree to comply with all event rules and regulations. Failure to adhere to these terms may result in denial of entry or removal from the event.
12. Photography and Media Release
12.1. The event may be recorded or photographed for promotional purposes. If you do not consent to images or video being shared by the Organiser, it is the Attendee’s responsibility to advise the Organiser by emailing: intuitive@device.com.au.
13. Authenticity and Validity of Tickets
13.1. Entry to the event may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been cloned, damaged or defaced in any way, or has not been obtained through the formal registration process.
14. Delivery and Redemption of Tickets
14.1. Upon registration, a ticket will be emailed to the address provided. Attendees will need to produce the ticket at the Event for entry.
14.2. Suitable and valid identification may be requested for redemption of tickets and at the event.
15. Limitations on Number of Tickets Purchased
15.1. When purchasing tickets for the event, attendees may be limited to a specified number of tickets. If the stated ticket limit is exceeded, DTA may cancel any or all orders and tickets without notice.
16. System Errors
16.1. DTA may cancel an order made as a result of any system error.
17. Intellectual Property
17.1. All materials presented or distributed at the event are protected by copyright and may not be reproduced without the organiser’s permission.
18. Waiver & Indemnity
18.1. DTA, the organisers, the Venue and any other third-party contractors engaged by the organisers or the Venue will not be responsible for any personal injury, loss, or damage to property that occurs during the event.
18.2. Assumption of Risk: The Attendee acknowledges that they attend the event at their own risk, including but not limited to possible personal injury, loss of property, and/or unforeseen circumstances. The Attendee voluntarily assumes all such risks associated with attending in the event.
18.2.1. Personal Injury: The Attendee agrees to indemnify and hold harmless the Organiser, its employees, agents, and representatives from any and all claims, demands, actions, or causes of action arising out of or related to any personal injury sustained by the Attendee while participating in the event. This includes any injuries caused by the negligence of the Organiser or any third parties.
18.2.2. Loss of Property: The Organiser is not responsible for any loss, theft, or damage to the Attendee's personal property while attending the event. The Attendee agrees to indemnify and hold harmless the Organiser from any and all claims related to the loss or damage of personal property.
18.2.3. Medical Treatment: In the event of a medical emergency, the Attendee consents to receiving medical treatment deemed necessary by the Organiser or medical professionals. The Attendee agrees to indemnify and hold harmless the Organiser from any and all claims related to such medical treatment.
18.2.4. Compliance with Event Rules: The Attendee agrees to comply with all event rules and regulations set forth by the Organiser. Failure to comply with these rules may result in the Attendee's removal from the event.
19. Force Majeure:
19.1. The Organiser reserves the right to cancel or modify the event due to unforeseen circumstances beyond their control (“Force Majeure Event”), including but not limited to acts of God, fire, accident, pandemic, interruptions to energy supply, strike, riot, civil commotion or war whether declared or not., or other emergencies. The Attendee agrees to indemnify and hold harmless the Organiser from any and all claims related to such cancellations or modifications.
19.2. While the organisers will do all things reasonably necessary to mitigate the effect of the any Force Majeure Event on the performance of its obligations, it may cancel or defer reschedule the event at its sole discretion. In a Force Majeure Event, the organisers will endeavour to provide notice to the attendee which sets out in reasonable detail the nature of the Force Majeure Event and the steps taken to mitigate its effect.
20. Disclaimers
20.1. Logistics: DTA and the organisers will not be liable for any disruptions or inconveniences caused by technical failures, equipment malfunctions, or venue issues.
20.2. Finance: In the event of cancellation or rescheduling, neither DTA nor the organiser will be responsible for any costs incurred by attendees for travel, accommodation, or other related expenses.
20.3. Weather: DTA will not be liable for any adverse weather conditions that may impact the event. Attendees are advised to check weather forecasts and plan accordingly.
20.4. Legal: Attendees are responsible for their own actions and must comply with all applicable laws and regulations. DTA will not be liable for any legal issues arising from the actions of attendees.
21. Severability
21.1. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
22. Governing Law
22.1. These terms and conditions are governed by the laws of New South Wales, Australia.
